I ran two separate tests to duplicate the issue.
Test #1 I was able to duplicate it.
Test #2 I was not able to duplicate it.

I tested on my machine with the following configuration:
Operating System: Windows XP
OOo Version: 3.3.0 - OOO330m20 Build:9567
MS-Office Version : 2010

Test #1 - Steps where I was able to reproduce:
1. Created a new document is MS Word
2. Click on the File tab, and then select Options
3. Select Customize Ribbon
4. Over on the right side, be sure that Developer is checked
5. Click OK
6. Click on Developer Tab
7. Click on Legacy Tools icon
8. Click on "Checkbox" icon.
9. Double Click on Checkbox
10. Select "Checked" under "Default Value" section
11. Click OK
12. (optional step) Write a label after checkbox to identify it.
13. Saved document as MS-Word 97-2003 .DOC file
14. Open document in OpenOffice Writer
15. Confirm that Checkbox is not checked
16. Close document without saving

Test #2 - Step where I was not able to reproduce:
1. Open the previously saved .DOC file
2. Click on Developer Tab
3. Click on Restrict Editing
4. Check the box "Limit formatting to a selection of style" under Formatting restrictions section
5. Check the box "Allow only this type of editing in the document" under Editing restrictions section
6. From drop down select "Filling in forms" under Editing restrictions section
7. Saved document as MS-Word 97-2003 .DOC file
8. Open document in OpenOffice Writer
9. Confirm that Checkbox is checked

I am attaching two documents the represent each test and will exhibit the exact outcomes I reported above.

There was another issue (#118482) that seemed to be a duplicate of this one, but investigating it, it seems to be more a “font” checkbox issue and not related to this issue.
