possible inadvertent use of image on front page

right now, on the front page is posted an image, winner of the German poster contest http://www.openoffice.org/branding/images/poster_1.jpg there may be a problem displaying this image: http://www.skyphab.com/2004/news_current.php "wired situation: someone took my smiley picture from photocase.de, wrapped a "k' 'stenlos" around the smiley and won the openoffice.org picture contest. in fact, it's allowed to use the pictures from there in a commercial or non-commercial way, but you have to mention the originator of the picture and that's what he didn't do. i'm proud that people like my picture, but it would me make happy if people knew that it's my picture and not the one from marco. additionally openoffice.org uses it at the main site, becuase they think it's the winner's picture, but it's not! everything i want is a link to my homepage! openoffice.org is a great project, i'm curious what they will say. marco if you read that: why didn't you drop me a short info that you used my picture as it's written on photocase.de?" on the contest page, http://de.openoffice.org/marketing/plakatwettbewerb/winner.html is given credit for the author (as requested): "The photo for this poster has been taken from PhotoCase.de. The photo has been provided by skyphab.com." but not also on OOo front page i think we not want to use any materials whitout the author accept, and we should either: 1) receive accept for use the image from the author 2) remove the image from the website 3) add a disclaimer - "The photo has been provided by skyphab.com"

hi nicubunu. We (webmasters@ooo and germanophone project) already have been noticed about this image. We are in contact with skyphab and he describes the situation somehow in his news. The situation is as follwos: - he agreed, that we could use the image, if we add the disclaimer at least to the list of contest winners. - to honor his (not known) contribution he recieves an 160GB harddisk and a brand new 1000 pages book about OOo (as soon as it will be available) - we all (project, the main sponsor and skyphab) agreed, that we are not very happy, that Marco Weismüller didn't tell us, that we had to put the disclaimer for photocase.de to the poster. But we all agreed, that this was not by bad intention, but rather because the terms of use at photocase.de are not easy to find and to understand. I'll leave it to Louis to add the disclaimer at the homepage (to me, it is not neccesarry, as we have permissions by skyphab)
As the image isn't displayed anymore I'll close as fixed
